LASTING POWER OF ATTORNEY

 

A Lasting Power of Attorney (LPA) is a Legal Document whereby you grant another (the “attorney”) the right to deal with your financial affairs should you become unable to manage them yourself, for any reason, whilst you are alive.

 

You specify in what circumstances the LPA may be used; whether straight away, or if you become unable for any reason to handle your own affairs.

 

You appoint who shall become responsible for your affairs in the event of the specified reason above occurring (your “attorney”) and if more than one you decide whether they have to take all decisions together; some decisions together and some independently; or if they can act independently of one another.

You can impose restrictions on what your attorney may and may not do i.e. only deal with certain bank accounts or certain matters with the written consent of a specified relative. You decide upon the restrictions imposed.


The LPA can only be used when registered with the Office of Public Guardian.

By taking no action if you become unable to manage your affairs then the only way your relatives may do so is by an application to the Court of Protection, which is a time consuming and lengthy process. You no longer control who you wish to deal with your affairs or the circumstances in which they may do so. The Court decides for you and their decision may not be what you wanted.
